Aguilar was observed operating his vehicle on a public way.

The victim returned home to find the Christmas presents had been rummaged through. All of the wrapped presents were opened. A XBox video game system, XBox controllers and sneakers were stolen. The front door to the apartment does not appear to have been forced open.
